Welcome to GymCity, a SaaS-based Fitness Management Tool for businesses, provided by CodersBucket Ltd. (“GymCity,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of the services provided by GymCity. By accessing or using the GymCity platform or any of its services, you agree to these Terms. If you do not agree, you may not use GymCity.
1. Acceptance of Terms
By using GymCity, you confirm you have read, understood, and agree to be bound by these Terms, including any future modifications. If you’re entering into these Terms on behalf of an entity, you represent that you have the authority to bind that entity.
2. Definitions
GymCity processes your personal data transparently and fairly, in strict adherence to the General Data Protection Regulation (GDPR), for the following purposes:
- “Agreement” includes these Terms, the Privacy Policy, and any other documents or addenda agreed upon between you and GymCity.
- “Authorized User” is an employee or agent authorized to use GymCity under the account of a subscribing organization, like a gym.
- “Confidential Information” covers all non-public information considered confidential between parties, including GymCity technology and subscriber data.
- “Services” refer to GymCity’s offerings, including membership management, scheduling, and communication tools.
- “Subscriber Data” means any data entered into GymCity by subscribers or their users.
- “User” or “End User” refers to individuals authorized to use GymCity, including gym members and personal trainers.
- “Privacy Policy” governs the collection, use, and sharing of personal information on GymCity.
3. Eligibility
You must be at least 18 years old or the age of majority in your jurisdiction to use GymCity. By using GymCity, you warrant that you meet this requirement.
4. Service Features
GymCity offers a suite of tools to manage gym operations and enhance member experience, The features include, but are not limited to:
- Membership Management: Create and manage gym memberships.
- Scheduling: Organize workouts and manage gym resources.
- Health Records Management: Securely store and access member health records.
- Communication Tools: Email, SMS, and push notifications for effective communication.
- Invoice and Payment Tracking: Manage invoices and payments (excluding real-time processing).
- Personal Trainer Profiles: Enable trainers to showcase their offerings.
- Internal Messaging: Facilitate direct communication within the platform.
- Diet Chart and Location Information: Provide diet plans and manage gym locations.
Multi-Connection Capability: Connect gyms, members, and trainers for a broad range of services and interactions.
5. Data Management and Responsibilities
5.1 Ownership and Rights to Data
- Subscriber Data Ownership: You retain rights to your data, granting us a license to use it for service delivery and enhancement.
- Member Data Ownership: Members own their personal data, with rights governed by applicable laws.
5.2 Data Processing and Responsibilities
- GymCity as Data Processor: We process data based on your instructions, in line with our DPA.
- Gym’s Role as Data Controller: Gyms must comply with data protection laws when handling member data.
5.3 Data Security, Confidentiality, and Usage
We use business and member data within our agreement’s scope and adhere to strict data security standards.
5.4 User Obligations and Compliance
You’re responsible for the accuracy and legality of your data and must comply with all relevant laws.
5.5 Data Retention, Portability, and Deletion
We’re not responsible for data storage post-termination. We support data portability and deletion requests as per applicable laws.
5.6 Aggregated Anonymous Data
We may use anonymized data for business improvement without identifying sources.
6. Intellectual Property Rights
GymCity and its licensors own all content and software. You’re granted a limited license to use our services, subject to these Terms. Unauthorized use of our trademarks is prohibited.
7. User Conduct
Users must act responsibly and respectfully. Prohibited activities include unauthorized account access and illegal actions.
8. Termination
We may terminate or suspend your access for any reason, including Terms violations.
9. Limitation of Liability
We are not responsible for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of, or inability to use, our services, to the fullest extent permitted by law.
10. Governing Law
These Terms are governed by the laws of the jurisdiction where GymCity operates, excluding conflict of laws principles.
11. General Terms
11.1 Assignment
This Agreement cannot be transferred without GymCity’s written consent, though GymCity may transfer it to an affiliate or through business restructuring without such consent.
11.2 Waiver and Severability
Waivers must be in writing to be effective. If any part of these Terms is held invalid, the remainder will still apply.
11.3 Entire Agreement
These Terms, along with any related documents, form the complete agreement between you and GymCity, superseding any prior agreements. Changes to these Terms require mutual written consent.
11.4 Compliance with Laws
You agree to use GymCity services in compliance with all applicable laws.
11.5 Force Majeure
GymCity is not liable for delays or failures caused by events beyond our reasonable control, such as natural disasters or governmental actions.
11.6 Equitable Relief
Violations of these Terms may lead GymCity to seek injunctive or other equitable relief.
11.7 Relationship of Parties
Your relationship with GymCity is that of an independent contractor. This Agreement does not create a partnership or joint venture.
11.8 Electronic Communications
You consent to conducting transactions and receiving notices electronically in connection with GymCity services.
11.9 Marketing Consent
You consent to GymCity using publicly available data for marketing purposes, with an option to opt-out by contacting GymCity directly.
11.10 Data Utilization
GymCity commits to using public data responsibly for promoting community engagement and visibility, in line with our Privacy Policy.
11.11 Opt-Out Option
Users can opt out of marketing uses of their public data by contacting GymCity, ensuring control over their information.
11.12 Responsibility and Accuracy
While GymCity strives for accuracy in representations, users are responsible for ensuring their public data is current and accurate. GymCity is not liable for inaccuracies in such

We reserve the right to modify these Terms at any time. We will provide notice of any significant changes and, by continuing to use the service, you agree to be bound by the revised Terms.
